ISPs and Broadband Providers Reminded to Renew Their DMCA Designated Agents
JSI reminds all ISPs and broadband service providers to renew their designated agent registrations with the U.S. Copyright Office in order to keep their safe harbor protection under the Digital Millennium Copyright Act (DMCA). Registrations have a three-year life, and since many companies made registrations in 2017, most will require renewals this year. Companies are receiving renewal notifications and may be looking to update existing registrations.
The safe harbor protection limits ISP and broadband provider liabilities in the event one or more of the providers’ subscribers commits copyright infringement. In order to be protected, providers must have an updated DMCA Designated Agent registered with the Copyright office, as well as a Copyright Infringement Enforcement Policy implemented and posted on their websites. Those policies should give the company authority to suspend or terminate the accounts of repeat infringers.
